Section 15
To take action against the Managing Director and other employees
: (1) If it is believed that the Managing Director has misused or exceeded the authority prescribed by this Act or the rules and regulations made under this Act, or has embezzled the assets or funds of the Institute, the Government of Nepal shall And other employees may be suspended by the committee.
(2) According to sub-section (1), the suspended Managing Director may be examined by a judge of the High Court appointed by the Government of Nepal or a person who has the qualifications to be such a judge, and in the case of other employees by a person deemed appropriate by the committee.
(3) For the purpose of this section, all the powers of the district court in relation to taking statements, filing of documents, understanding of witness evidence shall be vested in the judge or the person appointed to conduct the investigation under sub-section (2).
(4) Considering the report of such investigations, the Government of Nepal in the case of the Managing Director and the committee in the case of other employees may issue an order to impose any type of punishment specified in the rules and regulations.
(5) If not satisfied with such an order, the Managing Director may file an appeal with the Supreme Court and other employees may file an appeal with the Government of Nepal in accordance with the prevailing law. The decision on the above appeal will be final.
(6) A person suspended in accordance with sub-section (1) shall not receive any salary for the period of such suspension. But if the charges are not proven and acquitted, the suspended person will get full salary for the period of suspension.
